Terms of Service

These Terms of Service (“Terms”) govern your use of modernpaintingandroofing.com (the “Site”) and any services provided by Modern Painters LLC (doing business as “Modern Painting & Roofing,” “we,” “us,” “our”). By using the Site or requesting services, you agree to these Terms.

1. Services

Modern Painting & Roofing provides residential and commercial painting services (interior, exterior, cabinet, and epoxy floor coating) and roofing services (replacement, repair, storm & hail damage, inspection, ventilation, and gutters) in Southeast Wisconsin, including Waukesha County and Greater Milwaukee. Roofing work is performed by our licensed Wisconsin roofing partner; painting work is performed by our own team.

2. Estimates & Bookings

Requests submitted through the Site are inquiries, not binding contracts. A project is confirmed only when we accept it and provide a written estimate or agreement. Estimates are valid for the period stated and are subject to on-site verification of conditions. Pricing, scope, and any change-order terms are governed by the written agreement you sign for the specific job, which controls over these Terms in case of conflict.

3. Scheduling, Access & Cancellations

You are responsible for providing safe, timely access to the property and disclosing relevant conditions. Cancellation, rescheduling, and deposit terms are as stated in your written estimate or agreement. Exterior work may be rescheduled due to weather.

4. Payment & Taxes

Payment terms are stated in your estimate or agreement. Applicable Wisconsin and local sales taxes may be added where required by law. Late payments may incur fees as permitted by Wisconsin law.

5. Workmanship Warranty

We stand behind our work with a written workmanship warranty. The specific coverage and term are set out in your written agreement for the job and control over any general description on the Site. Manufacturer warranties on materials (e.g., paint or roofing products) are provided by the manufacturer under their own terms.

6. Licensing & Roofing Partner

We are licensed, bonded, and insured for the services we provide in Wisconsin. Roofing services are fulfilled by an appropriately licensed and insured Wisconsin roofing partner under a separate scope. We do not represent that we hold any out-of-state license for work performed in Wisconsin.

7. Insurance & Storm-Damage Work (Wisconsin)

For roofing or repair work that may be covered by property insurance, we comply with Wisconsin law, including Wis. Stat. § 100.65. We do not advertise or promise to pay, waive, rebate, or absorb any insurance deductible, and we do not negotiate or adjust insurance claims on your behalf — doing so is prohibited by Wisconsin law. Any decision about a claim is between you and your insurer. We provide honest assessments and quality work; the insurance process and any deductible remain your responsibility.

8. Property Condition & Pre-Existing Damage

We are not responsible for pre-existing damage, defects, or conditions not caused by our work — including but not limited to failing substrates, rot, prior improper installation, hidden conditions, or surfaces unsuitable for coating. We use professional methods appropriate to each surface and will notify you where a surface presents risk; we may decline that portion of the work.

9. SMS / Electronic Communications

By providing your phone number and opting in, you consent to receive SMS messages as described in our Privacy Policy. Message frequency varies; message and data rates may apply; reply STOP to opt out, HELP for help. You also consent to receive electronic communications and agree they satisfy any legal requirement that communications be in writing.

10. Disclaimers

The Site and services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, except any warranty expressly stated in a signed agreement.

11. Limitation of Liability

To the fullest extent permitted by Wisconsin law, Modern Painters LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from the Site or services. Our total aggregate liability for any claim will not exceed the amount you paid for the specific service giving rise to the claim. Nothing limits liability that cannot be limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Modern Painters LLC from claims, damages, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or misuse of the Site.

13. Intellectual Property & Third-Party Links

All Site content, branding, text, images, and design are owned by or licensed to Modern Painters LLC and may not be used without permission. The Site may link to third-party sites (including our Arizona sister site); we are not responsible for their content or practices.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Wisconsin, and you consent to that jurisdiction and venue.

15. Changes, Severability & Entire Agreement

We may update these Terms; continued use after changes constitutes acceptance. If any provision is unenforceable, the rest remains in effect. These Terms, together with any signed agreement and our Privacy Policy, are the entire agreement between you and us regarding the Site.
